Suspended Director Challenges Access Ban, Raises Concerns Over Due Process

THE HAGUE – The suspended acting director of the Curaçao House in The Hague, Martha Semil, has formally challenged her removal from office, arguing that the decision violated due process and was based on incorrect information.

In a detailed objection, Semil states that she was never heard before being denied access to the Cabinet of the Minister Plenipotentiary, calling the measure unjustified and procedurally flawed.

She maintains that throughout her tenure, she consistently shared relevant information with authorities in Curaçao, including through emails, messaging platforms, and the submission of complete personnel files when required.

A key issue in the dispute revolves around access to personnel records. Semil argues that requests from Willemstad exceeded previously agreed parameters and that her refusal to provide full access was rooted in privacy obligations and administrative responsibility.

The objection also raises concerns about possible conflicts of interest, suggesting that individuals involved in advising or investigating the situation may themselves be candidates for positions within the Cabinet.

The case has gained additional attention due to political scrutiny in Curaçao, particularly regarding a reported financial irregularity. Semil has dismissed the allegation as a misunderstanding, emphasizing that no fraud occurred.

She further claims that confidential documents related to her case were leaked, contributing to reputational damage and shaping public perception before a proper assessment could take place.

As investigations continue, including an anticipated review by the Algemene Rekenkamer Curaçao, Semil is urging that due process and impartiality be safeguarded.

The outcome of the case is expected to have broader implications for governance, oversight, and administrative practices within Curaçao’s representation in the Netherlands.
