THE HAGUE – The Supreme Court of the Netherlands has overturned a judgment involving Fundashon Kas Popular (FKP) in a dispute over rental arrears and prescription rules in the Caribbean legal system.
The case, registered as ECLI:NL:HR:2026:1302, concerns a dispute between FKP and a tenant regarding unpaid rent and whether the housing foundation could still pursue those outstanding amounts after the passage of time.
The Supreme Court ruled that the earlier decision of the Gemeenschappelijk Hof van Justitie could not stand and referred the case back to the Court for further consideration.
The ruling does not mean that the tenant has automatically won the case or that the rental debt has been cancelled. Instead, the Supreme Court determined that the lower court must reconsider the matter using the legal principles outlined in the judgment.
The case is important because it addresses the application of prescription rules in the Caribbean legal environment and the balance between legal certainty and the recovery of long-standing debts.
The Supreme Court also ordered FKP to pay the costs of the cassation proceedings.
