Lawyers Raise Concerns About Legal Safeguards in Proposed Extradition Law

WILLEMSTAD – While the Curaçao Bar Association has distanced itself from being seen as the source of criticism, attorneys participating in consultations on the proposed Kingdom Extradition Act did raise several legal concerns about the draft legislation.

According to the Bar Association, comments submitted by a group of criminal defense lawyers focused on issues including the legal protection of individuals facing extradition, the principle of specialty, and the role of the Governor within the extradition process.

The lawyers also questioned aspects of the Governor’s constitutional position in extradition cases and highlighted what they believe are important legal considerations that lawmakers should examine before the legislation is finalized.

The Bar Association emphasized that these observations came from individual legal practitioners rather than from the organization itself. However, it stressed that allowing attorneys to contribute their expertise during legislative consultations is an important part of the lawmaking process.

The organization noted that such professional input helps improve legislation and strengthens the rule of law.

At the same time, the Bar Association reiterated its respect for the constitutional framework of the Kingdom. It stated that the Governor performs a recognized constitutional function within the countries of the Kingdom and exercises powers established under existing legislation.

The proposed Kingdom Extradition Act seeks to update and standardize extradition rules across Aruba, Curaçao, and Sint Maarten. Discussions on the bill are ongoing as lawmakers continue reviewing the proposal and feedback received during the consultation phase.
