WILLEMSTAD – Fundashon E Hende will appeal the August 17 court ruling concerning the sale of public housing in Curaçao. The foundation says its case was not sufficiently developed from a legal standpoint in the first proceedings and now wants the Joint Court of Justice to reconsider the matter.
Fundashon E Hende announced its decision on Friday, days after losing the case involving what the organization describes as the purchase and sale of public housing.
Following consultations with experts, the foundation says it concluded that an appeal is necessary. In announcing the decision, Fundashon E Hende also acknowledged shortcomings in the way its own case was initially presented.
According to the foundation, the petition filed by its legal adviser, Artoire Herrera, was inadequately prepared. Fundashon E Hende says it has documents, evidence and other material that it intends to use during the appeal in an effort to address those shortcomings.
The foundation maintains that the eventual transfer of public housing to residents is unavoidable. It argues that existing legislation provides rights that should allow residents to acquire the homes they occupy.
The dispute is part of a broader campaign by Fundashon E Hende concerning public housing and the allocation of government-owned land in Curaçao.
The organization has also called for a parliamentary inquiry into housing foundation FKP and FFP and into the allocation of hundreds of government plots, including questions about who ultimately benefited from those transactions.
With the appeal, Fundashon E Hende hopes to obtain a different judicial assessment of its arguments concerning the sale and transfer of public housing.
The Joint Court of Justice will now be asked to review the case.
