FKP Ordered to Pay Cassation Costs After Supreme Court Overturns Judgment

THE HAGUE – Fundashon Kas Popular (FKP) has been ordered to pay the costs of cassation proceedings after the Supreme Court overturned a previous ruling by the Gemeenschappelijk Hof van Justitie.

The Supreme Court ruled that the earlier judgment from November 26, 2024 could not remain in place and returned the case to the Court for a new assessment.

In its decision, the Supreme Court ordered FKP to reimburse the tenant’s costs in the cassation procedure, including legal costs.

The financial consequences of the ruling are limited to the cassation proceedings. The Supreme Court did not determine the final outcome of the underlying rental dispute.

The case will now continue before the Gemeenschappelijk Hof van Justitie, which must issue a new decision taking the Supreme Court’s legal interpretation into account.

The ruling once again places attention on the challenges faced by social housing organizations, which must balance their public mission with financial sustainability.
