Debate over constitutional reform raises concerns for Curaçao’s role within the Kingdom

THE HAGUE – A proposed reform in the Netherlands to allow courts to review laws against constitutional rights is sparking debate over the position of Curaçao and other Caribbean countries within the Kingdom.

The proposal aims to partially lift the long-standing ban on constitutional review by judges, but legal experts warn that the chosen approach could sideline the influence of Curaçao, Aruba, and Sint Maarten.

According to the analysis, parts of the Dutch Constitution also apply across the Kingdom, meaning changes can have implications beyond the Netherlands alone.

However, experts argue that the Dutch government’s decision to pursue the reform through a Kingdom law (rijkswet) may not be appropriate, potentially limiting the procedural role of Caribbean countries in shaping the outcome.

The issue highlights ongoing tensions within the Kingdom structure, where legal changes in the Netherlands can have ripple effects across the Caribbean, raising questions about equal participation and constitutional balance.
