Debate Grows Over Minister’s Role in Conditional Release Decisions

WILLEMSTAD – Proposed changes to Curaçao’s criminal legislation are sparking debate over the role of the Minister of Justice in decisions related to conditional release.

The draft law introduces the possibility of requiring a financial guarantee—often referred to as a form of “bail”—as part of conditions for early release after a final conviction.

Several political parties have expressed concern that granting such authority to the minister could create risks of imbalance or misuse. Critics argue that decisions of this nature should remain under judicial oversight.

The government, however, maintains that the measure is not intended to allow individuals to “buy their freedom,” but rather to strengthen compliance with conditions such as reporting requirements, treatment programs, or electronic monitoring.

Authorities stressed that any decision would be based on advice from the Central Probation Council and tailored to the financial capacity of the individual involved.

Still, the government acknowledged the concerns raised and indicated that the provision could be reconsidered or removed during further legislative discussions.
