Court Introduces Digital Access to Dutch Supreme Court Cases for Caribbean Kingdom

WILLEMSTAD – Residents and legal professionals in the Caribbean part of the Kingdom will now be able to conduct cassation proceedings digitally before the Dutch Supreme Court, ending what the Joint Court of Justice describes as a longstanding legal inequality within the Kingdom.

According to the Court’s Annual Report 2025, the new digital access system became operational on December 1, 2025. Parties in Aruba, Curaçao, Sint Maarten and the BES islands can now use the same digital cassation portal already available in the Netherlands.

The Court says the reform was achieved after years of collaboration with the Supreme Court of the Netherlands.

In criminal cases, only lawyers and members of the Public Prosecution Service can use the digital system. In tax cases, individuals representing themselves may choose digital access, while companies, government entities and professional representatives are required to use it digitally.

The Joint Court itself plays a central role in the process. Front office staff assist users in obtaining authentication credentials and linking accounts to the proper case files.

According to the Court, the reform strengthens judicial accessibility and creates a more uniform digital judicial system throughout the Kingdom.
