Court Dismisses All Claims Against Me — Freedom of Expression Upheld

Opinion, Op-Ed, | By Luigi Faneyte November 4, 2026

On November 2, 2026, the Court of First Instance of Curaçao dismissed all claims brought against me by Mario Fiorini, IGA Trust, and Phaedra Hanst in case CUR202504781. The requested restrictions on my public statements, demands for corrections, and claims for damages were all rejected.

The case concerned my investigations and publications regarding potential irregularities in Curaçao’s online gambling industry, including concerns surrounding BC.Game, licensing practices, regulatory oversight, and possible conflicts of interest.

The Court recognized my role as a public watchdog — someone who conducts critical investigations in the public interest and contributes to public debate.

The Court found that I had sufficient factual grounds to investigate and publicly raise these concerns. It also found no evidence that I knew, or should have known, that my criminal complaints were unfounded.

Regarding public criticism of Fiorini, the Court observed: “If you dish it out, you must be prepared to take it.”

This ruling does not mean that all the allegations investigated have been proven. It does, however, confirm that raising well-founded concerns about a sector of significant public interest deserves protection under Article 10 of the European Convention on Human Rights.

Throughout the proceedings, I deliberately chose to remain publicly restrained. I left the matter to the Court. I am grateful that the judgment has now provided clarity.

My counterclaim alleging a Strategic Lawsuit Against Public Participation (SLAPP) was also dismissed. I respect that decision. Given the seriousness of the allegations, I recognize the right of the other parties to seek judicial review of my statements. The Court did not find an abuse of legal proceedings in this case.

At the same time, I believe Curaçao should further strengthen legal protections for journalists, independent investigators, and individuals who report suspected wrongdoing, while safeguarding both freedom of expression and the right to protect one’s reputation.

My sincere gratitude goes to my attorney, Mr. André Small, for his dedicated and professional representation. I also appreciate the independent investigative work of Lilith Wittmann and other journalists who continue to raise critical questions about the iGaming industry.

My investigations will continue — responsibly, factually, and in the public interest.
