Resident Holds TUI Blue Resort Developers Liable for Alleged Construction Nuisance and Health Damage

WILLEMSTAD – An 82-year-old resident of Coral Cliff has formally held the developers behind the nearby TUI Blue Resort Coral Cliff project liable for alleged health damage, environmental nuisance, and loss of living enjoyment caused by ongoing construction activities.

In a formal liability letter, resident Sara S.E.N. Katri states that she has suffered “structural, prolonged, and excessive nuisance” since construction work on the resort began more than two years ago.

According to the letter, the disturbance exceeds what can reasonably be expected in society and qualifies as unlawful nuisance under Curaçao civil law.

Katri claims the project differs substantially from what was originally presented to residents.

According to her, what had initially been described as an ecological resort has evolved into a large-scale development with multi-story concrete structures. She argues that this alleged misrepresentation directly influenced her residential decisions and negatively affected her quality of life.

The complaint lists several forms of alleged nuisance and damage, including daily noise pollution from approximately 6:30 a.m. until 9:30 p.m., dust pollution, heavy construction traffic along narrow access roads, and the use of explosives without adequate prior communication to residents.

The resident further alleges environmental damage involving nature areas, the sea, and coral reefs, as well as contamination from construction waste.

According to the letter, the situation has also led to health problems.

Katri states that she has experienced respiratory complaints linked to dust exposure and says she was advised by doctors to adapt her living environment because of air quality concerns. She additionally reports stress and migraine complaints allegedly caused by the ongoing noise and disruption.

The resident also says she incurred additional expenses, including cleaning costs and other measures intended to reduce the impact of the construction nuisance.

In the letter, Katri argues that residents were not properly informed in advance about the scale, duration, and nature of the project, which she says prevented them from taking appropriate protective measures.

She is demanding compensation totaling USD 25,000 for material damages, health-related damages, and immaterial damages tied to loss of living enjoyment and quality of life.

The letter gives the developers fourteen days to acknowledge liability, enter discussions regarding a structural solution and compensation, and transfer the requested amount.

If no satisfactory response is received, the resident says she reserves the right to pursue additional legal steps.

The case adds to growing debate on Curaçao surrounding large-scale coastal development projects, environmental concerns, and the impact of tourism-related construction on nearby residential communities.
