Withheld €125,000 won must be refunded by online casinos in Curacao

WILLEMSTAD - Usoftgaming, the company behind the online casinos Betswagger and Ph.Casino, has lost a lawsuit from the SBGOK. In total, six people demanded money that had not been paid out by the casinos. According to website casinonieuws.nl, the judge ruled in favor of all six and now Usoftgaming has to pay more than € 125,000. In addition, the judge ruled that licensor Cyberluck can be held jointly and severally liable for the mistakes that companies with a sublicense commit.  

 

The Curacao gambling company Usoftgaming has lost a lawsuit filed by some of their customers and the Stichting Belangenbehouding Online Kansspelen (SBGOK) Foundation. Usoftgaming offers online games of chance through a license from the Curaçao Cyberluck 

 

The lawsuit concerns six people who, for various reasons, demanded money from the online casinos Betswagger and the erotic Ph.Casino. Both online casinos are owned by Usoftgaming 

 

In all cases, Usoftgaming was not proved right, as the company was unable to prove its views sufficiently. In addition, the general terms and conditions of the online casinos, which Usoftgaming always relied on, could not be saved by the customers. As a result, the authenticity of the general terms and conditions is insufficiently guaranteed, as can be read in the ruling.  

 

In addition, Cyberluck can be held jointly and severally liable for errors committed by companies with a sublicense. Cyberluck is one of the companies with a Curaçao license. In turn, the company may issue sublicenses to online casinos. These online casinos pay Cyberluck for this.  

 

The judge's ruling describes that Cyberluck itself does not offer online gambling activities. This is outsourced to other companies such as Usoftgaming. The companies pay a fee for this.  

 

The judge refers to another similar ruling in which it was held that the main licensee is responsible for the mistakes that holders of such a sub-licence commit.
