Scammer of Divi Divi and Hotel ‘t Klooster sentenced to one year in prison

WILLEMSTAD - In the cyber case 'Exodus', defendant C.C. Curiel has been sentenced to 365 days in prison, with a conditional deduction of 273 days for pre-trial detention, under special conditions. The court announced the verdict on Tuesday. 

The special conditions include probation supervision. Curiel was convicted of defrauding Divi Divi Air and Boutique Hotel ‘t Klooster in Pietermaai. 

"The defendant's criminal behavior was solely aimed at his own financial gain, without regard for the privacy and property of others," the public prosecutor stated during the mid-June hearing. 

The defendant purchased bots (computers infected with malware). These bots had already been hacked before Curiel acquired them. Although this is illegal and wrong, he did not directly defraud the bot owners to obtain them. The judge found no evidence that Curiel used stolen credit cards. While the defendant did use many different cards and addresses, which is suspicious, there was insufficient evidence to prove they were stolen. 

Therefore, the court partially acquitted Curiel. He will not be prosecuted for "defrauding unknown creditors," and regarding the charge of "forgery," the judge ruled that the indictment was partially invalid due to "insufficient factual description."
