WILLEMSTAD - The construction of the Pen Resort in Pietermaai has resumed. On November 28, the Minister of Transportation, Traffic, and Spatial Planning (VVRP), Charles Cooper, issued a new permit.
The building permit for the resort on Penstraat was nullified on November 1, based on a court decision. The project was planned to cover about 21 hectares and reach a height of 20 meters. However, the maximum building height at the location, in urban residential areas, is 8 meters.
When a building in an urban residential area exceeds 8 meters in height, a balancing of interests is required. This was not sufficiently motivated during last month's court case.
The lawsuit was filed by three plaintiffs living directly next to and opposite the construction site. They reportedly informed the legal counsel of the VVRP ministry, Giselle Hollander, that they would not appeal.
