Government: Harsher Sentences May Help Prevent Crime, But No Guarantees

WILLEMSTAD – The Curaçao government says that proposed increases in maximum criminal penalties are intended to strengthen deterrence, but acknowledges that their impact on crime rates cannot be guaranteed.

The changes are part of broader amendments to the Criminal Code aimed at addressing serious offenses, including those linked to terrorism.

Officials emphasized that maximum penalties are rarely imposed in practice, as judges retain broad discretion to determine appropriate sentences based on the circumstances of each case.

The government noted that sentencing is influenced by multiple factors, including the severity of the crime, the offender’s background, and the need for rehabilitation.

While higher penalties may contribute to general deterrence, authorities cautioned that their preventive effect varies depending on the type of crime.

There are currently no plans to lower the age of criminal responsibility, despite discussions in other countries about prosecuting younger offenders.
