Driver Acquitted After Traffic Fine for Tinted Windows Lacks Evidence

WILLEMSTAD – A 24-year-old driver in Curaçao has been fully acquitted by the court in a case involving a traffic fine for allegedly overly tinted car windows. The case was dismissed after it became clear that the police report contained no concrete measurements or evidence regarding the level of tint on the vehicle’s windows.

The driver, identified as G.B., was stopped by police during a traffic control on Schottegatweg. According to the officer involved, the windshield and front side windows were considered too dark and therefore in violation of traffic regulations. The driver was instructed to remove the window film and was subsequently fined.

G.B. disputed the allegation, stating that the tint on his vehicle’s windows was within the legally permitted limits. He argued that the officer had not used any measuring equipment to determine the percentage of light transmission and that the fine was issued without objective verification.

During the court hearing, it emerged that the police report did not specify how dark the windows were, nor did it indicate that any measurements had been taken. As a result, there was insufficient evidence to establish that a legal violation had occurred. The Openbaar Ministerie acknowledged this lack of proof and formally requested an acquittal.

The judge agreed with that assessment and ruled that the charge could not be substantiated, leading to the full acquittal of the driver and the dismissal of the traffic fine.
