Double fatality of divers at Damen's faulted as culpable homicide

WILLEMSTAD - In the "Damen" investigation, the fatal diving accident that occurred on September 29, 2020, on the wharf near Damen Shiprepair Curaçao's shipyard was investigated. In this accident, two divers from a specialized contractor who were performing their duties lost their lives. 

The results of the criminal investigation confirm the suspicion that on September 21, 2020, there was a case of 'culpable homicide.' A thorough evaluation of all the facts, circumstances, and interests in this case resulted in the decision to offer Damen Shiprepair Curaçao a transaction to avoid criminal prosecution. The Public Prosecutor's Office informed the victims' families about this. The Public Prosecutor's Office considers this transaction an appropriate arrangement. 

On October 5, 2023, the Public Prosecutor's Office and Damen Shiprepair Curaçao concluded the transaction. Damen Shiprepair Curaçao does not admit guilt, but it feels a special moral responsibility to the families of the two victims. In this context, Damen Shiprepair Curaçao pays an amount of 300,000 guilders to the families of the two victims. Additionally, Damen Shiprepair Curaçao pays a transaction of 50,000 guilders. It must be proven and verified that this amount will be invested in the training and education of the personnel working at Damen Shiprepair Curaçao. 

The investment contributes to preventing similar accidents in the future. Furthermore, Damen Shiprepair Curaçao has adapted its processes and management and has taken measures to prevent further accidents.
