WILLEMSTAD - The criminal record of MFK Member of Parliament Eduard Braam remains unchanged following a recent court ruling. Despite Braam's appeal to have his record expunged, the court decided otherwise earlier this week. This decision has significant implications as Braam's eligibility for ministerial positions was hindered due to his criminal history.
Braam's inability to serve as a minister in the current cabinet stemmed from his failure to pass the mandatory screening process. The root of the issue lies in his 2002 conviction for indecent acts committed while working as a company doctor. In the past, criminal records like Braam's were typically expunged after 20 years. However, a legislative amendment in 2004 extended this period to 80 years.
The crux of Braam's argument rested on the timing of his conviction, predating the 2004 amendment. He contended that his case should fall under the previous 20-year expungement rule. Nevertheless, the court ruled that the amended law applies retroactively, encompassing verdicts issued prior to its enactment.
