Court Orders RKCS to Negotiate with Union DOEN

WILLEMSTAD The Court of First Instance of Curaçao has ruled that the Roman Catholic Central School Board (RKCS) acted unlawfully by excluding the Sindikato di Dosente Edukashon Nobo (DOEN) union from discussions on employment conditions. The school board must now include the union in labor disputes involving employees who are members of DOEN. The court has also established rules for both parties to ensure constructive dialogue in the future. 

The case arose after RKCS refused to engage in discussions with DOEN in August, citing concerns about the union’s communication and actions. The court ruled that employees have the right to be represented by the union of their choice, provided the dispute pertains to primary employment conditions. Both parties are expected to adhere to an agreed protocol to maintain a professional and constructive dialogue. 

RKCS and DOEN have been instructed to resume discussions under these conditions. Each party will bear its own legal costs. 

Union Welcomes the Ruling 

Union DOEN expressed satisfaction with the verdict. “The interests of our members and all employees at RKCS are once again safeguarded!” said Marbella Felipa, chairperson of DOEN. She described the ruling as a significant victory for union rights and a step toward mutual respect. Felipa also emphasized the union’s willingness to collaborate with RKCS following the newly established dialogue rules. 

“Following the union struggle and victory in 1975 for union participation, we consider this ruling a historic moment for the labor movement in the education sector. It reaffirms what the union movement on this island has achieved since the 1970s: union participation,” Felipa stated. She called on all stakeholders to work together toward a constructive future for schools, staff, and students.
