AMSTERDAM – Individuals who apply late for their Dutch state pension (AOW) permanently forfeit missed payments, even if they were unaware that an application was required or experienced issues with DigiD while living on Curaçao. That is the ruling of the Rechtbank Amsterdam in a case brought by a Curaçao resident against the Sociale verzekeringsbank (SVB).
The claimant reached retirement age under the Algemene Ouderdomswet (AOW) in 2021 but did not submit his application until April 2024. The SVB granted the pension effective April 1, 2023 — one year prior to the date of application, which is the maximum retroactive period permitted under the law.
The man argued that he should receive AOW benefits dating back to 2021. He stated that he was unaware that he had to file the application himself and cited difficulties obtaining or using DigiD, as well as delays during the COVID-19 pandemic, as reasons for not applying earlier.
No Exceptional Circumstances
The court rejected those arguments. Under the AOW, pensions can be granted retroactively for a maximum of one year. Only in exceptional situations — referred to as a “special case” — may this limit be extended.
According to the court, such exceptions apply only when a person was genuinely unable to submit an application in time due to circumstances beyond their control, such as serious illness or excusable unawareness of entitlement.
In this case, the court concluded that no such exceptional circumstances existed. Not knowing that an application had to be submitted was deemed the claimant’s own responsibility. Likewise, problems related to DigiD or delays in obtaining access were considered circumstances for which he remained responsible.
The court further noted that any differences in administrative practice in Curaçao regarding retroactive benefits do not override Dutch legislation governing the AOW.
Broader Implications for the Caribbean Part of the Kingdom
The ruling is particularly relevant for residents of the Caribbean part of the Kingdom who are entitled to a Dutch AOW pension. The court made clear that AOW benefits do not commence automatically and that the responsibility for timely application lies entirely with the individual.
Failure to act in time can result in the permanent loss of pension payments — even if the omission is only discovered years later.
