OM to start confiscation case against Constancia

WILLEMSTAD - The Public Prosecution Service (OM) will start a confiscation case against Member of Parliament Jacinta Constancia. This is according to OM spokesman Roderick Gouverneur. It is not yet known when the confiscation procedure will be started. 

Former Minister of Health, Environment, and Nature Constancia was sentenced two weeks ago on appeal to 21 months in prison for fraud and corruption. In 2012, as a minister, she ordered 40,000 medical face masks. The bill of more than 365,000 guilders was paid to a company that her then-husband Jhony Anbertus Scoop had set up the day before the order. He must also spend 21 months in jail. According to the OM, confiscation proceedings are also being initiated against Scoop. 

In confiscation proceedings, if someone has obtained financial benefit from a criminal offense, the Public Prosecution Service can file a claim with the court for the confiscation of so-called illegally obtained advantage. 

Constancia also filed an appeal in cassation on September 16 against the ruling of September 10. This means that the case will be reviewed by the Supreme Court in the Netherlands. The case can then be dismissed or referred back to court.
