Lawsuit against 'illegal construction' gas station landfill

WILLEMSTAD - The gas station operators' associations Copda (Curaçao Oil-Products Distributors Association) and Asogas (Asosiashon di Doñonan di Pomp die Gasolin) have started a lawsuit in connection with the illegal construction of a new gas station at the entrance of the landfill.  

 

 

According to Copda and Asogas, the gas station along the Weg naar Westpunt is contrary to the location policy and construction started without the necessary permits. The gas station owners state that Sebier Attaf is behind the plans with his companies St. Helena Pompstation nv, Pabow Real Estate bv and Three Stars Private Foundation. “The actions of Attaf and his companies are unlawful towards Copda and Asogas now that they are apparently deliberately trying to illegally gain a competitive position against the rules,” said lawyer Achim Henriquez on behalf of the associations.  

 

In addition to the protest from Copda and Asogas, a so-called 'stop letter' has also been sent to Attaf, which explicitly refers to the possibility of demolishing the illegal structure. The associations asked both Minister of Traffic, Transport and Spatial Planning (VVRP) Charles Cooper and Minister Ruisandro Cijntje of Economic Development (MEO) to proceed with enforcement. So far, no response has been received nor has it been enforced, according to the gas station owners.  

 

Copda and Asogas want the illegal gas station to be demolished at the expense of the clients and that a penalty payment is attached to this. In addition, according to the gas station owners' associations, it is important that 'action can be taken by themselves' if the government and the defendants ignore the verdict, despite the penalty.
