WILLEMSTAD – The Curaçao Rental Commission has established its first-ever official procedural regulations, aimed at providing clarity and legal certainty for both tenants and landlords. The new regulations, which took effect on March 14, are designed to ensure more efficient and fairer procedures in rental disputes.
Clear Guidelines for Rental Disputes
The newly implemented rules outline how parties should conduct themselves during proceedings and specify deadlines and procedures to be followed. For example:
Speaking time during hearings is limited to a maximum of ten minutes per party.
Petitions must include all relevant documents and contact details.
Late submissions may be disregarded if they are not received within the required timeframe before a hearing.
The Rental Commission retains the right to make exceptions when necessary, such as in cases of illness or unforeseen circumstances like accidents.
Increased Transparency and Public Access
Another key provision in the new regulations is that rulings will be made public and may be published on the Rental Commission’s website. In cases where privacy protection is required, decisions may be anonymized before publication.
With this first official procedural framework since its inception, the Curaçao Rental Commission aims to promote greater transparency, efficiency, and fairness in resolving rental disputes across the island.
