BT&P informs on supervisory duty in the postal market

WILLEMSTAD - Bureau Telecommunicatie en Post (hereafter: BT&P), in the first quarter of 2019, organizes information sessions concerning applicable regulations to couriers, to which all stakeholders involved will be invited.

Regulation and the postal market

As a member state of the Universal Postal Union (hereafter: UPU) Curaçao is required to adhere to international postal obligations resulting from the Acts of the UPU or other treaties or resolutions of international organizations. Through national regulations each member state must apply the aforementioned international regulation.

The highest national postal legislation in Curaçao is Postlandsverordening (the National Ordenance regulating the Post). The impact of this legislation is regulated in the secondary postal legislation. Based on this legal framework BT&P, on behalf of the Minister of Traffic, Transportation & Urban Planning, supervises the postal sector. The postal sector consists of, among others, the concession holder, or Cpost International N.V., and other couriers that offer their services.

Concession & other regulation

To ensure a proper service provision, Cpost International N.V., according to concession rules, has been granted the exclusive right to transport letters in Curaçao up to 2,000 grams, to install mailboxes on the public road and to issue postage stamps.

Other couriers than the concession holder also have the right to transport letters up to 2,000 grams, provided the letter can be traced (track and trace system), the transportation fee for letters is not set below a minimum of NAf. 10,00 in Curaçao and is at least NAf. 20,00 to foreign countries, the delivery time is significantly shorter compared to the regular express transportation time by the concession holder and the courier pays an annual registration fee. Couriers that don’t meet one or more of the abovementioned criteria are in violation of the law, which will have legal consequences. The regulations above are included in the Postlandsverordening 1998 (National Ordenance regulating the Post) and are further defined in the Beschikking registratie koeriersdiensten (Decree for the registration of courier services) en Landsbesluit minimumtarieven koeriersdiensten (National Resolution for minimum rates of courier services).

BT&P, as the supervisory authority of the postal market, strives to guarantee the quality of postal services at all times. In this regard BT&P will be organizing information sessions shortly to discuss postal regulation, in which all couriers will be informed of the relevant legal obligations and consequences in case of violation of the law.
